Policies & Agreement

* Things to keep everyone safe

This agreement (“Agreement”) is entered into between House of Joy & Light Photography — a LaunchCrate Brand (“Photographer”) and the undersigned client(s) (“Client”) for the purpose of providing portrait photography services.

PURPOSE OF AGREEMENT

The purpose of this Agreement is to set forth the terms and conditions under which both parties agree to collaborate on a professional portrait photography project wherein the House of Joy & Light Photography will capture images of the Client for personal use.

TERMS & CONDITIONS

​

1. Booking and Payment:

A non-refundable deposit equal to 50% of the session fee is required to secure the Client’s booking.

  • For all packages separate from Heirloom Package, the remaining 50% balance is due 7 days prior to the scheduled session date.

  • For the Heirloom Package, payment is structured as 50% deposit at booking, and 25% due before each session (Fall and Spring).

  • Session dates will not be held without a deposit.

  • Payment may be made through credit card, debit card, or electronic fund transfer through the Photographer's online payment system.

  • Failure to pay the balance by the due date may result in cancellation of the session and forfeiture of deposit.

2. Cancellations & Rescheduling:

    • Deposits are non-refundable.

    • Sessions may be rescheduled once, with at least 72 hours notice, and the deposit will transfer to the new date (subject to Photographer’s availability).

    • Sessions canceled with less than 72 hours notice, or clients who do not attend their scheduled session, forfeit the deposit.

3. Session Expectations:

    • Client agrees to arrive on time and prepared. Time lost due to tardiness cannot be added to the session.

    • Outfit changes and locations must be planned within the agreed session duration.

    • Photographer is not responsible for wardrobe, styling, or weather conditions beyond their control.

    • In the event of inclement weather, the Photographer reserves the right to reschedule at no additional cost to Client.

4. Delivery of Images:

    • Edited digital images will be delivered via a secure online gallery (Pic-Time).

    • Delivery timelines vary by package but average 3 weeks after the session.

    • Rush editing (3–5 days) may be available for an additional fee.

    • Client will receive the number of images stated in the package description.

5. Copyright & Usage Rights:

    • Photographer retains full copyright of all images created.

    • Client is granted personal usage rights only (printing, sharing online, personal archiving).

    • Images may not be altered, sold, or used commercially without written permission.

    • Photographer reserves the right to use images for portfolio, website, marketing, and promotional purposes unless Client submits a written request for exclusion prior to the session.

6. Liability:

    • Photographer is not liable for injuries, damages, or loss sustained during the session.

    • In the unlikely event of equipment failure, illness, or unforeseen emergency, Photographer will either:

      • Reschedule the session, or

      • Refund all payments made (including deposit), releasing Photographer from further liability.

7. Model Release:

    • By signing this Agreement, Client grants Photographer the right to use images for promotional purposes, as outlined above. Client may opt out by notifying Photographer in writing prior to the session.

8. Governing Law:

This Agreement shall be governed by the laws of the State of Kansas and/or Missouri, depending on the location services are rendered.
